State statute tells us what is required to file a Petition For Dissolution Of Marriage (aka divorce proceeding) in Missouri courts. Section 452.310 of the Missouri Revised Statutes lists that the Petition
1) Must be verified. Verified means that you are swearing and signed by a notary that what is put in the Petition is true and accurate to the best of your knowledge;
2) Must state that the marriage is irretrievably broken and that, therefore, there remains no reasonable likelihood that the marriage can be preserved. If there remains a likelihood that the marriage could be preserved, then you should maybe consider a “legal separation” (there will be a dedicated blog post later on this topic) instead of a dissolution;
3) Sets forth the residence of each party, including the county and the length of residence of each party in this state and in the county of residence;
4) Sets forth the length of the marriage and the place at which it is registered;
5) Sets forth the date on which the parties separated;
6) Sets forth the name, age, and address of each child, and the parent with whom each child has primarily resided for the sixty days immediately preceding the filing of the petition for dissolution of marriage;
7) Sets forth whether the wife is pregnant;
8) Sets forth the last four digits of the social security number of the petitioner, respondent, and each child;
9) Sets forth any arrangements as to the custody and support of the children and the maintenance of each party; and
10) Sets forth the relief sought (aka what are you asking the court for specifically)
As you can see there is quite a bit of information needed just to start the proceedings in Missouri state court and it can quickly become confusing.
